Terms of Service

1. Agreement

These Terms of Service (“Terms”) govern your access to and use of GameSim (“the Service”), provided by Espada Studio (“we”, “us”, “our”). By using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Description of the Service

GameSim is a web-based tool that allows users to design and simulate game economies. The Service is provided “as-is” without guarantees of uninterrupted operation.

3. Accounts

• You must create an account to use the Service.
• Authentication is handled by Clerk.
• You are responsible for maintaining control over your login credentials.
• You must be at least 16 years old to use the Service.

4. Subscription and Payments

• Paid plans are billed through Stripe.
• All prices are shown before tax unless stated otherwise.
• Subscription renews automatically unless cancelled.
• You may cancel at any time. Refunds are not provided for partial billing periods.
• We reserve the right to change pricing with reasonable notice.

5. User-Generated Data

• Any simulations, projects, or files you create remain your property.
• We store this data only to provide the Service.
• You are responsible for exporting backups if needed.
• We may delete inactive data after account closure.

6. Acceptable Use

You agree not to:

• Attempt to hack, reverse engineer, or disrupt the Service
• Use the Service for illegal purposes
• Upload malicious code or automated scraping tools
• Pretend to be someone else or misrepresent ownership of data

7. Intellectual Property

• All Service code, branding, and design belong to Espada Studio.
• You may not copy or redistribute internal code, UI assets, or system logic.

8. Service Availability

We may update, modify, or temporarily suspend parts of the Service for maintenance or upgrade purposes. We are not liable for:

• Downtime
• Data loss caused by user error or external factors
• Third-party integrations failing (Clerk, Stripe, etc.)

9. Disclaimer of Warranty

The Service is provided “as-is” and “as available”, without warranties of any kind. We disclaim all implied warranties, including:

• Fitness for a particular purpose
• Non-infringement
• Continuous availability

10. Limitation of Liability

To the maximum extent permitted by law:

• We are not liable for indirect, incidental, or consequential damages
• Our total liability will not exceed the amount you paid in the last 6 months of Service usage
• If you use the free version, liability is capped at €0

11. Termination

You may delete your account at any time. We may suspend or terminate your access if:

• You violate these Terms
• We are required by law
• The Service is discontinued

Upon termination, your access is removed, but you may request export or deletion of stored data.

12. Changes to Terms

We may update these Terms from time to time. The latest version will always be available on our website. Material changes will be announced via email or in-product notice.

13. Governing Law

These Terms are governed by Portuguese law, unless required otherwise by local consumer regulations.
